Property Litigation

We handle all forms of property litigation and related advisory matters. We act for a variety of major Irish (and foreign Irish-located) property companies and developers, investment and pension funds and other businesses with major property concerns such as shopping centres, hotels, bar and restaurant enterprises.

A&L Goodbody also has a specialist Leisure and Licensing Group which links in with our property clients whose property interests are in that industry sector. We also have a specialist Environmental and Planning Group working extensively with our property clients.

We have considerable experience in acting for both landlords and tenants of commercial properties and in conjunction with our Property Department provide a seamless, integrated service from initial lease negotiation through to the resolution of disputes arising in connection with tenancies of all types.

We also advise on all VAT and tax issues arising in these transactions.

Key recent cases:

  • Successfully representing and advising Erin Executor & Trustee Co. Limited in relation to the recovery of substantial VAT from the Revenue Commissioners relative to VAT paid on leases.
  • Advising and successfully representing a large domestic bank in relation to property litigation regarding the banks’ former headquarters.
  • Advising Xtra-vision on all aspects of their leased properties both contentious and non-contentious, from both landlord and tenant perspectives.
  • Advising Quarryvale Ltd., landlords of Liffey Valley Shopping Centre, on all property issues, contentious and non-contentious.
  • Advising Coltard Ltd. in relation to the management of Dun Laoghaire Centre including litigation regarding "keep open" obligations and peaceful re-entry.
  • Advising the Irish Property Unit Trust in relation to litigation regarding rent deposits, recovery of rental arrears and breach of covenant concerning Airside Retail Park in Swords.
