New Regulations Impose Tough Fines For Unsolicited Communications

New Regulations came into effect on 13th December 2008, which toughen the law in respect of unsolicited communications for direct marketing purposes. The Regulations amend the European Communities (Electronic Communications Networks and Services) (Data Protection and Privacy) Regulations 2003 (S.I. No. 535 of 2003).

The Planning & Development (Enforcement Proceedings) Bill 2008 was published on 15 December 2008 by Deputy Mary Upton. This is a Private Members’ Bill and it is very rare for such Bills ever to be into passed into law. Only one Private Members' Bill published by a member of the Oireachtas since January 2002 has been enacted into law.

Under the new Directive, consumers shopping on the internet and on the main street will be entitled to clear information on price and additional fees/charges before they enter into any contract.
