New Regulations Impose Tough Fines For Unsolicited Communications (12/23/2008): New Regulations came into effect on 13th December 2008, which toughen the law in respect of unsolicited communications for direct marketing purposes. The Regulations amend the European Communities (Electronic Communications Networks and Services) (Data Protection and Privacy) Regulations 2003 (S.I. No. 535 of 2003).
New Planning & Development (Enforcement Proceedings) Bill published (12/22/2008): The Planning & Development (Enforcement Proceedings) Bill 2008 was published on 15 December 2008 by Deputy Mary Upton. This is a Private Members’ Bill and it is very rare for such Bills ever to be into passed into law. Only one Private Members' Bill published by a member of the Oireachtas since January 2002 has been enacted into law.
ODCE Focus on Disqualification for Offences relating to a Company (12/16/2008): At the recent conference of the Health and Safety Lawyers Association of Ireland, the Legal Adviser to the ODCE spoke about their focus on enforcement of the automatic disqualification provisions in Section 160 of The Companies Act, 1990, of persons convicted of an indictable offence relating to a company.

Financial Regulator Reviews The Intermediary Market (12/16/2008): The Financial Regulator has published a report of the joint Financial Regulator and industry working group set up to review the intermediary market and in particular, terms used to categorise insurance and mortgage intermediaries and transparency in relation to the services provided to consumers by such intermediaries (the "Report").

Awards Ordered Against Insurance Companies Puts Complaints Procedure and Powers of the Financial Services Ombudsman in the Spotlight Again (12/02/2008): As we reported last week, the Financial Services Ombudsman, Mr. Joe Meade has released details of 21 significant decisions he made, in respect of insurance companies, in the second half of last year, 11 of which were upheld and 10 rejected.
New Regulation for Serving Judicial Documents Comes into Effect (12/02/2008): A new EU Council Regulation on the service of judicial and extra judicial documents came into effect on 13 November 2008.
Sale of Goods Legislation to be Reviewed by Expert Group (12/02/2008): The European Commission recently announced that it is proposing to introduce EU-wide consumer rights in the form of a new Consumer Rights Directive. Under the new Directive, consumers shopping on the internet and on the main street will be entitled to clear information on price and additional fees/charges before they enter into any contract.
