No hiding from minority oppression – husband of shareholder found guilty of oppression
This ALG Soundbite considers the recent case of Mascarenhas v Karim and Anor, where the Court of Appeal upheld a High Court finding of shareholder oppression under section 212 of the Companies Act 2014. Most notably, the Court found that shareholder oppression proceedings under section 212 can be brought against individuals even where they are neither a director nor a shareholder of the company.
